Terms and Conditions of Sale

These general terms and conditions of sale (hereinafter the “T&Cs”) apply, without restriction or reservation, to all sales concluded online by the company ANGELYK SAS with consumers and, where applicable, non-professionals, via the website www.mocybell.com (hereinafter the “Site”).
The purpose of these T&Cs is to define the conditions of ordering, payment, delivery and management of returns of the products offered for sale (hereinafter the “Products”). The T&Cs are accessible at any time on the Site and may be saved or printed.

2) Acceptance of the T&Cs
The Buyer declares that they have the legal capacity required to enter into a contract. Acceptance of the T&Cs is materialized by ticking a checkbox during the ordering process. Any acceptance subject to reservation shall be deemed unwritten.
3) Products
The Products are described and presented with the greatest possible accuracy. However, minor variations (shades, photo rendering, presentation) may exist without engaging the Seller’s liability.
Safety warning: some Products contain small parts. Not suitable for children under 36 months (risk of ingestion). Do not swallow.
The Products are offered within the limits of available stock. In the event of unavailability after an order has been placed, the Buyer will be informed and a refund will be offered.
4) Order
4.1 Process
The Buyer selects the Products, checks the cart, provides the requested information (delivery/billing), then confirms the order. Mandatory fields must be completed in order to validate the purchase.
4.2 Customer account
The creation of a customer account may be offered. The Buyer is responsible for the confidentiality of their login credentials. In the event of fraudulent use, the Buyer must contact the Seller via the contact form.
4.3 Confirmation
After validation, an order confirmation is displayed on screen and generally sent by automatic message to the address provided. The Buyer must verify the accuracy of their contact details.
5) Prices
Prices are indicated in euros, all taxes included (VAT included), excluding any delivery costs. The applicable delivery costs are indicated before validation of the order (cart/checkout).
For shipments outside the European Union, customs duties and local taxes may be required upon receipt. They remain the responsibility of the Buyer.
6) Payment
Payment is due immediately upon ordering. The available payment methods (credit card, PayPal, Amazon Pay, etc.) are those offered at the time of payment on the Site.
The Seller reserves the right to suspend or cancel an order in the event of non-payment, payment incident, or suspicion of fraud.
Retention of title: the Products remain the property of the Seller until full payment has been received.
7) Delivery
The Products are delivered to the address indicated by the Buyer when placing the order. The delivery methods (carrier, options, rates, free shipping thresholds) and estimated delivery times are displayed in the cart/checkout and may vary depending on the destination and the amount of the order.
Important: the announced delivery times are indicative times. A delay does not automatically entitle the Buyer to damages. However, in the event of a significant delay, the Buyer has the rights provided by consumer law.
7.1 Timeframes
Unless otherwise indicated at checkout, orders are prepared as quickly as possible (excluding weekends, public holidays, and annual leave). Delivery times vary depending on the destination.
7.2 Tracking
When available, shipment tracking information is provided. The Buyer must check the condition of the parcel upon receipt. In the event of a visible anomaly (damaged or opened parcel), the Buyer must, if possible, make reservations with the carrier and contact the Seller via the contact form.
8) Right of withdrawal
In accordance with consumer law, the Buyer has a minimum legal withdrawal period of 14 days. ANGELYK SAS extends this period to 30 days from receipt of the Products, to exercise the right of withdrawal without having to provide a reason.
To withdraw, the Buyer must inform the Seller of their decision via the contact form (or by postal mail), then return the Products.
- Return costs remain the responsibility of the Buyer, except in the event of an error attributable to the Seller or a defective/non-compliant Product.
- The Products must be returned complete, in their original packaging when possible, without excessive use and with their accessories.
- Proof of purchase (invoice / order number) may be requested to facilitate processing.
Refund: in the event of withdrawal, the Seller refunds the sums paid (Products + standard delivery costs), no later than 14 days from the recovery of the Products, or from proof of shipment provided by the Buyer, whichever occurs first.
9) Legal guarantees
The Buyer benefits from the legal guarantees:
- Legal guarantee of conformity (Consumer Code, articles L.217-3 and following)
- Warranty against hidden defects (Civil Code, articles 1641 and following)
In the event of a defective, damaged or non-conforming Product, the Buyer must contact the Seller via the contact form specifying the order number and describing the problem (photos may be useful).
Depending on the case, the Seller will offer repair, replacement, or refund in accordance with applicable regulations.
10) Liability
The Seller cannot be held liable for damages resulting from improper use of the Products, failure to comply with warnings, negligence, or use not in accordance with the intended purpose of the Product.
The Seller may interrupt access to the Site for maintenance. Its liability cannot be engaged in the event of network disruptions or external events (force majeure).
11) Intellectual property
All content present on the Site (texts, visuals, logos, photos, trademarks, etc.) is protected by intellectual property law. Any reproduction, representation or unauthorized use is prohibited.
12) Personal data
Personal data collected in the context of orders are processed in accordance with the privacy policy available on the Site.
13) Mediation & dispute resolution
In the event of difficulty, the Buyer is invited to contact customer service via the contact form. In accordance with consumer law, the Buyer may also use a consumer mediation service free of charge. The contact details of the competent mediator (or the procedure for referral) are communicated upon request via the contact form, and/or in the legal notices of the Site where applicable.
For online purchases within the EU, the Buyer may also use the European Online Dispute Resolution platform (ODR) made available by the European Commission.
14) Modifications of the T&Cs
The Seller reserves the right to modify the T&Cs at any time. The applicable T&Cs are those in force on the date the order is validated by the Buyer.
15) Applicable law & competent jurisdiction
These T&Cs are governed by French law. In the event of a dispute, and failing an amicable resolution, the competent courts will be determined in accordance with the applicable legal rules, particularly those relating to consumers.
